By reserving your stay at Ocean Blue, you (the “Responsible Guest”) agree to abide by the following Terms & Conditions. These terms are designed to protect your experience, preserve the property, and ensure compliance with the Encinitas Municipal Code (EMC) and applicable laws.

1. Parties to the Agreement

This Rental Agreement is between

Sembrose LLC (“Owner”) and You, the Responsible Guest—the individual making the booking, submitting payment, and agreeing to all terms herein.

2. Responsible Guest Obligations

Must be 25 years or older, be present during the stay, and use a valid credit card.

Must inform all guests, invitees, and visitors of these terms and ensure compliance.

Is fully responsible for any damages, code violations, or legal infractions caused by their group.

Agrees to defend, indemnify, and hold harmless Sembrose LLC from any claims or penalties arising from violations or negligence.

3. Stay Details

Check-In: After 3:00 PM

Check-Out: By 11:00 AM

Maximum Occupancy: 8 guests total (including children and infants) per EMC § 9.38.050

4. Payments & Deposits

50% payment due at booking, balance due 14 days before arrival.

A $5,000 security hold will be authorized at check-in.

A nonrefundable Damage Waiver Fee covers up to $5,000 in reported accidental damages (intentional or negligent damages are not covered).

5. Property Rules (EMC-Compliant)

Quiet Hours & Conduct

Quiet Hours: 10:00 PM – 8:00 AM

Top Deck Quiet Zone: No loud music, shouting, or unsupervised children—24/7.No parties or events, commercial filming, or large gatherings.

No roof access or climbing onto walls.

All local, state, and federal laws must be followed.

Parking

Maximum 2 vehicles, parked in the front driveway.

No parking in the alley, garage front, or blocking sidewalks.

Smoking & Fire Safety

No smoking or vaping, indoors or outdoors. Includes cannabis and e-cigarettes.

No charcoal or wood-burning fires.

Propane BBQ only, at least 10 feet from any structure.

Pets & Vehicles

No pets allowed.

No RVs, trailers, or campers permitted.

No subletting or unregistered overnight guests allowed.

6. Use of Amenities

Hot Tub: Saltwater. Shower before use. No unsupervised children. Replace and secure cover after use.

Pool Table: No objects or drinks on the table or cover.

Fireplace: Gas only. Open glass doors before use. Do not insert wood or foreign objects.

Outdoor Shower: Use to rinse off sand before entering the home. Do not rinse sand down indoor drains.

7. Security & Safety

Security Cameras: Installed externally at all four corners; Ring doorbells at both entry points.

Damages: Any unreported damage or excessive cleaning will be charged to the card on file.

8. Cleaning & Checkout

Please ensure the following before departure:

Load and run the dishwasher

Take out all trash and recycling

Replace outdoor furniture covers

Turn off all lights and HVAC systems

Lock all doors and enter your checkout code

Excessive cleaning or dump runs incur a charge of $75/hour plus disposal fees

9. Maintenance & Repairs

Report issues within 48 hours; we’ll respond within the same timeframe.

No refunds for temporary outages or minor repairs.

If the home isn’t clean upon arrival, notify us within 12 hours for re-cleaning.

10. Cancellation Policy

100% refund if canceled 30+ days before arrival.50% refund if canceled 14–29 days before arrival.

No refund if canceled less than 14 days before arrival.

11. Violations & Eviction

Any violation may result in immediate eviction without refund and forfeiture of the deposit. Grounds for eviction include, but are not limited to:

Exceeding guest limits

Unauthorized pets or guests

Noise violations

Smoking

Illegal substances or activity

Lewd or threatening conduct

Public intoxication

Refusal to vacate at checkout

12. Legal Terms

This agreement is non-transferable and may not be sublet.

Sembrose LLC reserves the right to inspect the property to enforce terms.

Disputes shall be governed under California law.

The prevailing party in litigation is entitled to reasonable attorney fees.
